- MVC/40B issue is an existential fight for the Island’s ability to manage and maintain its character.
- Edgartown Gardens/Green Villa developer seeking to remove the MVC from its role in reviewing and regulating 40B projects by demoting it to “local board” status.
- These tend to be the largest, densest and most impactful developments on the Island.
- Under 40B, Towns do not have the same authority as the MVC to regulate development
- Cannot control nitrogen discharges to the Great Ponds
- Cannot require open space preservation
- Cannot require same traffic mitigation
- Rural character of Island means nothing under 40B
- 40B particularly problematic on Island
- Developer only has to provide 20-25% of the units as income restricted affordable
- Rest are unrestricted, market-rate
- Basically creating large #s of investment properties, airbnbs, vacation rentals
- Worsens affordable housing crisis on Island – drives up cost of housing, creates more demand for workforce but without housing
- Only MVC – not towns – can condition 40B projects to prohibit short-term rentals, require greater % of affordability, require year-round occupancy, require workforce housing
- State Housing Appeals Committee has sided with developer
- Unfortunate that the administration is taking this position
- Completely at odds with Plain language of the MVC Act Prior court precedent 50 years of established practice
- MVC is litigating this in court, but Edgartown Gardens is moving forward even though MVC denied it and this developer has already proposed another 40B project in Edgartown -
- Hope is that Legislature will act to adopt legislation confirming that MVC is not a local board for 40B
- Need to call Moakley and Cyr and let them know that this is critical for the Island. Time sensitive outreach – want to get something in this legislative session before this gets out of hand
