In the name of the Commonwealth of Massachusetts, you are hereby directed to warn and notify the inhabitants of the Town of Chilmark, qualified to vote in elections and town affairs, to assemble at the Chilmark Community Center 520 South Road in said Town of Chilmark on Monday, the twenty-fourth day of May in the year Two Thousand and Twenty-One A.D. at five thirty o'clock in the evening 5:30 PM, there and then to act on the Articles in this Warrant, with the exception of Article One.

And to meet again in the Chilmark Community Center 520 South Road, in said Town of Chilmark on Wednesday, the twenty-sixth day of May in the year Two Thousand and Twenty-One A. D. 12 Noon, there and then to act on Article One of the Warrant by the election of Town Officers and action on Questions on the Official Ballot.

The polls for voting on the Official Ballot will be open at 12:00 PM Noon, and shall close at eight o'clock in the evening, 8:00 PM.

Question 1.      Shall the Town of Chilmark be allowed to exempt from the provisions of proposition two and one-half, so-called, the amounts required to pay for the bonds issued in order to pay costs of architectural services and construction of the Fire Station at 3 Menemsha Cross Road and the EMS building at 399 Middle Road, and for the payment of any and all other costs incidental and related thereto?                                                  Yes   No

Question 2.      Shall the Town of Chilmark be allowed to assess an additional $36,200 in real estate and personal property taxes for the purposes of funding the operating budget of the Up Island Regional School District (UIRSD) for the fiscal year beginning July 1, 2021?             Yes   No

Question 3.      Shall the Town of Chilmark be allowed to assess an additional $70,300 in real estate and personal property taxes for the purposes of funding the operating budget of the Martha’s Vineyard Regional High School District (MVRHSD) for the fiscal year beginning July 1, 2021?Yes   No

Question 10.    Shall the Town of Chilmark be allowed to assess an additional $35,590.60 in real estate and personal property taxes for the purposes of funding the replacement and installation of technology infrastructure at the Martha’s Vineyard Regional High School (MVRHS) for the fiscal year beginning July 1, 2021?                                                                           Yes   No

ARTICLE 2     To hear the reports of the Town Officers and Committees and act thereon.

ARTICLE 3.     To see if the town will vote to raise such sums of money as will be necessary to defray town charges and to make the appropriations for the ensuing year, as printed under Departmental Budgets - Salaries and Expenses totals, and that the amount set forth under the Community Preservation Committee (Dept. 179) shall be funded from the Community Preservation FY2022 Budgeted Reserve Fund Balance, further provided that the amount of $36,200 set forth under the Up Island Regional School District and $70,300 set forth under the MV Regional High School District in Department 300 Education shall be raised and appropriated only if a majority of voters casting ballots at the Annual Town Election to be held on May 26th 2021 vote in the affirmative to override proposition 2½.   Recommended by the Finance Advisory Committee - 6 Ayes - 0 Nays – 1 Absent

ARTICLE 4.    To see if the town will vote to raise and appropriate the sum of $5,000.00 and further appropriate the sum of $5,000.00 to be received from the Chilmark Town Affairs Council, subject to receipt, which amounts are to be added to the maintenance account of the Chilmark Community Center.

ARTICLE 5.    To see if the town will vote to transfer from available funds in the treasury the sum of $40,000.00 for a Reserve Fund to be administered by the Finance Advisory Committee, for the fiscal year beginning July 1, 2021.

ARTICLE 6.    To see if the town will vote to raise and appropriate the sum of $10,000.00 to fund the Reserve Fund for the Future Payment of Accrued Liabilities for Compensated Absences.

ARTICLE 7.    To see if the town will vote to transfer from available funds in the treasury the sum of $281,000.00 to the town’s stabilizations funds as follows:
$130,000.00 to be placed in the General Stabilization Fund,
$25,000.00 to be placed in the Fire Department Stabilization Fund, with the intent that it be put towards the replacement costs for fire apparatus which is over twenty-five (25) years in age,
$26,000.00 to be placed in the Police Vehicle Stabilization Fund,

ARTICLE 8.    To see if the town will vote to raise and appropriate the sum of $52,202.12 to be paid to the Up Island Regional School District as the Town’s share of the costs of the District’s capital project for the purchase and installation of services, supplies, equipment and materials related to replacing Doors in or on the Chilmark School building, including any other costs incidental and relative thereto; provided, however, that this appropriation shall not be effective unless each of the other member Towns of the District approve a corresponding appropriation for their respective share of the total project costs of $65,252.66; or to take any other action relative thereto, further provided that this appropriation be contingent on the approval of a Proposition 2½ capital outlay expenditure exclusion under General Laws Chapter 59, § 21C(i½).

ARTICLE 9.    To see if the town will vote to vote to raise and appropriate the sum of $153,376.07 to pay the Town’s share of the Up-Island Regional School District’s window replacement project at the Chilmark School providing design, procurement, installation, project management, and any costs incidental and relative thereto, provided that this appropriation be contingent on the approval of a Proposition 2½ capital outlay expenditure exclusion under General Laws Chapter 59, § 21C(i½).

ARTICLE 10.  To see if the Town will vote to raise and appropriate the sum of $9,547.17 to be paid to the Up Island Regional  School District as the Town’s share of the costs of the District’s capital project for the purchase and installation of services, supplies, equipment, machinery and materials related to replacing a Walk-In Cafeteria Refrigerator/Freezer in or on the West Tisbury School facility, including any other costs incidental and relative thereto; provided, however, that this appropriation shall not be effective unless each of the other member Towns of the District approve a corresponding appropriation for their respective share of the total project costs of $74,704.00; or to take any other action relative thereto, further provided that this appropriation be contingent on the approval of a Proposition 2½ capital outlay expenditure exclusion under General Laws Chapter 59, § 21C(i½).

ARTICLE 11.  To see if the Town will vote to raise and appropriate the sum of $5,779.82 to be paid to the Up Island Regional  School District as the Town’s share of the costs of the District’s capital project for the purchase and installation of services, supplies, equipment and materials related to replacing the elevator in the West Tisbury School building, including any other costs incidental and relative thereto; provided, however, that this appropriation shall not be effective unless each of the other member Towns of the District approve a corresponding appropriation for their respective share of the total project costs of $45,225.54; or to take any other action relative thereto, further provided that this appropriation be contingent on the approval of a Proposition 2½ capital outlay expenditure exclusion under General Laws Chapter 59, § 21C(i½).

ARTICLE 12.  To see if the town will vote to raise and appropriate the sum of $10,780.00 to fund the Town’s share of the administrative expenses of the All Island School Committee’s contract for Adult and Community Education in Fiscal Year 2022.

ARTICLE 13.  To see if the Town will vote to raise and appropriate the sum of $41,151.60 to be paid to the Up Island Regional  School District as the Town’s share of the costs of the District’s capital project for the purchase and installation of services, supplies, equipment and materials related to replacing a portion of the Roof in or on the West Tisbury School building, including any other costs incidental and relative thereto; provided, however, that this appropriation shall not be effective unless each of the other member Towns of the District approve a corresponding appropriation for their respective share of the total project costs of $322,000.00; or to take any other action relative thereto, further provided that this appropriation be contingent on the approval of a Proposition 2½ capital outlay expenditure exclusion under General Laws Chapter 59, § 21C(i½).

ARTICLE 14.  To see if the Town will vote to raise and appropriate the sum of $16,398.10 for the purpose of further reducing the Martha’s Vineyard Regional High School District’s Other Post-Employment Benefits (OPEB) liability, such sum to be paid to the Martha’s Vineyard Regional High School District as the Town’s share of the total cost of this supplemental OPEB liability payment; if approved, these funds will be placed in, and result in an increase to, the budget line item Education--Martha’s Vineyard Regional High School District for OPEB contributions of the District’s fiscal year 2022 budget for this purpose; provided, however, that this appropriation shall not be effective unless each of the other member Towns of the District approve a corresponding appropriation for their respective share of the total supplemental OPEB liability payment of $302,501.72; or to take any other action relative thereto.

ARTICLE 15. To see if the Town will vote to raise and appropriate the sum of $14,178.00 to be paid to the Martha’s Vineyard Regional High School District as the Town’s share of the costs of the District’s capital project for the purchase of two electric school buses and any other costs incidental and relative thereto, including, if costs and funding permit, associated equipment and fueling infrastructure costs, provided, however, that this appropriation shall not be effective unless each of the other member Towns of the District approve a corresponding appropriation for their respective share of the total project costs; or to take any other action relative thereto, further provided that this appropriation be contingent on the approval of a Proposition 2½ capital outlay expenditure exclusion under General Laws Chapter 59, § 21C(i½).

ARTICLE 16.  To see if the Town will vote to raise and appropriate the sum of $1,626.25 as the Town’s share of the costs of a capital project for the purchase and installation of services, supplies, and materials related to replacing exterior shingling at the Superintendent’s Office Building located at 4 Pine Street, Vineyard Haven, MA 02568, and any other costs incidental and relative thereto, such sum to be paid to and used by the Martha’s Vineyard Regional High School District for such purpose; provided, however, that this appropriation shall not be effective unless each of the other member Towns of the District approve a corresponding appropriation for their respective share of the total project costs; or to take any other action relative thereto.

ARTICLE 17. To see if the Town will vote to raise and appropriate the sum of $35,590.60 to be paid to the Martha’s Vineyard Regional High School District as the Town’s share of the costs of the District’s capital project for the purchase and installation of services, supplies, machinery, equipment and materials related to upgrading and replacing the technology infrastructure in or on the Martha’s Vineyard Regional High School buildings, including without limitation, network, wiring and wireless infrastructure, voice infrastructure, physical security infrastructure, server and backup infrastructure, data cabling infrastructure, design, engineering, and installation, and any other costs incidental and relative thereto; provided, however, that this appropriation shall not be effective unless each of the other member Towns of the District approve a corresponding appropriation for their respective share of the total project costs of $656,552.90; or to take any other action relative thereto, further provided that this appropriation be contingent on the approval of a Proposition 2½ capital outlay expenditure exclusion under General Laws Chapter 59, § 21C(i½).

ARTICLE 18. To see if the Town will vote to appropriate up to the sum of $11,100,000.00 to pay costs of constructing and originally equipping the new Fire Station at 3 Menemsha Cross Road and the EMS building at 399 Middle Road, and for the payment of all other costs incidental and related thereto, and that to meet this appropriation, the Treasurer, with the approval of the Selectmen is authorized to borrow said amount under and pursuant to M.G.L. c. 44, §7(1), or pursuant to any other enabling authority, and to issue bonds or notes of the Town therefor.  Any premium received upon the sale of any bonds or notes approved by this vote, less any such premium applied to the payment of the costs of issuance of such bonds or notes, may be applied to the payment of costs approved by this vote in accordance with M.G.L. c. 44, §20, thereby reducing the amount authorized to be borrowed to pay such costs by a like amount.

ARTICLE 19. To see if the town will vote to transfer $29,238.17 from Article 3 of the November 2017 STM (#141-9012) and transfer from available funds in the treasury the sum of $10,761.83 (totaling $40,000) to conduct property revaluation of the Town of Chilmark for Fiscal Year 2023, as well as required interim adjustments FY2024, 2025 & 2026 as mandated by the Commonwealth of Massachusetts, including the payment of costs incidental and relative thereto.

ARTICLE 20.  To see if the town will vote to transfer from available funds in the treasury the sum of $15,000.00 for budget software, departmental and bills-payable modules to town systems, including the payment of costs incidental and relative thereto.

ARTICLE 21.  To see if the town will vote to raise and appropriate the sum of $34,172.00 to pay the FY2022 operating costs of five regional services provided through Dukes County:

  • $4,822.00, as the Town’s proportionate share of the Fiscal Year 2022 cost to fund the Dukes County Social Services, based on the “50/50” formula.
  • $10,935.00 to fund the CORE program under the supervision of the Up Island Council on Aging.
  • $11,442.00, as the Town’s proportionate share of the Fiscal Year 2022 cost to fund the Healthy Aging Martha’s Vineyard for planning, community building and advocacy work for all Island elders, based on the “50/50” formula.
  • $5,972.00, as the Town’s proportionate share of the Fiscal Year 2022 cost to fund the Dukes County Substance Use Disorder prevention programs, based on the “50/50” formula.
  • $1001.00, as the Town’s proportionate share of the Fiscal Year 2022 cost to fund the Healthy Aging Task Force FIRST STOP, based on the “50/50” formula.

ARTICLE 22.  To see if the town will vote to transfer from available funds in the treasury the sum of $7,792.00 to fund the Dukes County Stabilization Fund.

ARTICLE 23.  To see if the Town of Chilmark will raise and appropriate the sum of $28,254.00 being the Town’s proportionate share of the Fiscal Year 2022 new maintenance costs of $166,188, new operational costs of $47,420 and new capital costs of $36,674, totaling $250,282; as related to the State-funded development and upgrades of the Dukes County Regional Emergency Communication Center and Radio System, such share based on the apportionment formula equal to an average of 16.67% fixed share of Island-wide new costs of $250,282 plus 5.91% variable share of such costs based on dispatch volume, for an average share of 11.29% for the annual payment of such costs under the Cooperative Agreement for Emergency Communications and Dispatch Services. The funding is contingent on all Island Towns paying for such new costs in Fiscal Year 2022 according to their agreed upon proportionate shares.                                    Submitted by Sheriff Robert Ogden

ARTICLE 26.  To see if the town will vote to transfer from available funds in the treasury the sum of $12,750.00 to fund the purchase of a replacement outboard engine and fuel system for the Shellfish Department boat, including the payment of costs incidental and relative thereto.

ARTICLE 27.  To see if the town will vote to transfer from available funds in the treasury the sum of $2,500.00 for the funding of PCR (Polymerase Chain Reaction) tests to be performed on water samples from Stonewall, Chilmark and Tisbury Great Ponds by the University of New Hampshire to determine what possible sources are contributing to the high fecal coliform bacterial contamination in the above mentioned water bodies.

ARTICLE 28.  To see if the Town will vote to approve the following requests of the Community Preservation Committee: 

  • To see if the Town will vote to reserve from the Community Preservation Fund FY 2022 estimated annual revenues up to the following amounts for community preservation projects:  $40,000.00 for the Community Preservation Reserve for Open Space; $40,000.00 for the Community Preservation Reserve for Historic Resources; $40,000.00 for the Community Preservation Reserve for Community Housing; and $280,000.00 for the Community Preservation Budget Reserve.
  • To see if the Town will vote to approve the following request of the Community Preservation Committee:  To see if the Town will vote to appropriate from the FY 2022 Community Preservation Reserve for Community Housing the sum of $15,000.00 as Chilmark’s share toward the acquisition of future housing for homeless female residents earning up to approximately 30 percent county median income.  The home will be purchased by the Island Housing Trust and leased to Harbor Homes of Martha’s Vineyard, Inc. for its exclusive use to serve homeless individuals.  The funds shall not be released until a closing date is scheduled for the property.  An appropriate affordable housing deed restriction shall also be filed with the deed to the property.  If the property is sold or its use changes, 100 percent of the funds shall be reimbursed to the Town of Chilmark Community Preservation Reserve for Community Housing.  If the Town has repealed the CPA the funds shall be reimbursed to the Town’s Molly Flender Affordable Housing Trust.
  • To see if the Town will vote to approve the following request of the Community Preservation Committee:  To see if the Town will vote to appropriate from the existing Community Preservation Reserve for Historic Resources the sum of $2,500.00 as Chilmark’s share to the Martha’s Vineyard Agricultural Society for the purpose of restoring the ox cart, historic artifacts and records and to build a case for the Ag Hall model.
  • To see if the Town will vote to approve the following request of the Community Preservation Committee:  To see if the Town will vote to appropriate from the FY 2022 Community Preservation Reserve for Community Housing the sum of $15,000.00 for a mixed use of housing and park & recreation to the Island Autism Group.  The request is Chilmark’s share of CPA funds being raised to partially fund the acquisition of 7.5-acres at 515 Lambert’s Cove Rd. in West Tisbury.  Three of the 7.5-acres will be dedicated to housing eligible people with autism needs preferably from the island and earning less than 100% AMI.  A permanent deed restriction will be placed on the affordable housing portion of land.  The remaining 4.5-acres will be used as a farm-based autism center and is the Open Space, Park & Recreation use.
  • To see if the Town will vote to approve the following request of the Community Preservation Committee:  To see if the Town will vote to appropriate from the FY 2022 Community Preservation Reserve for Historic Resources the sum of $15,000.00 to the Martha’s Vineyard Camp Meeting Association.  The request is Chilmark’s share of CPA funds being raised to restore the roof on the historic Tabernacle in Oak Bluffs.  This structure is listed in the National Registry of historic places.
  • To see if the Town will vote to approve the following request of the Community Preservation Committee:  To see if the Town will vote to appropriate from the FY 2022 Community Preservation Reserve for Open Space Park & Recreation the sum of up to $30,000.00 to fund a feasibility study to reconstruct the commercial dock, fuel dock and Dutcher dock in Menemsha Basin and plan for rising sea levels.
  • To see if the town will vote to approve the following request of the Community Preservation Committee:          To see if the Town will vote to appropriate from the Community Preservation Affordable Housing Reserve Fund the sum of $100,000.00 to replenish Chilmark’s rent subsidy program.  This program has been in existence since 2002 and is managed by the Dukes County Regional Housing Authority.  A transfer of $100,000 from the Community Preservation Undesignated Reserve Fund to the Affordable Housing Reserve Fund would be required to fund this appropriation.

ARTICLE 34.  To see if the Town will vote to transfer the sum of $731,800.00, subject to receipt, that being a portion of the proceeds of the sale of the parcel at 4 North Ridge Road, to the Town’s Molly Flender Affordable Housing Trust Fund.

ARTICLE 35. To see if the Town will vote to authorize the Board of Selectmen to petition the General Court to enact special legislation to re-name the executive body of the town of Chilmark, previously known as the board of selectmen, to be known as the select board of the town of Chilmark, which shall have all of the powers and authority of a board of selectmen under any general law, special law, or by-law, and providing that the members of the select board, previously known as selectmen, shall be known as select board members, or to take any other action relative thereto, provided that the General Court may make clerical or editorial amendments to the form of said proposed Special Act, and provided further that the Selectmen shall have the authority to approve and accept any such amendments.

ARTICLE 36.  To see if the Town will vote to adopt the following non-binding, aspirational goals in response to the developing climate change crisis:

Reduce fossil fuel use on the Island (from a 2018 baseline):

  • 50% by 2030
  • 100% by 2040

Increase the fraction of our electricity use that is renewable:

  • To 50% by 2030
  • To 100% by 2040

Foster biosphere carbon capture through:

  • Adoption of regenerative agriculture and landscaping
  • Protection and expansion of wetlands
  • Preservation of woodland resources;

and further, to request that the Town Energy Committee annually monitor progress toward the achievement of these goals.

ARTICLE 37.  To see if the town will vote to transfer from available funds in the treasury the sum of $ 7,420.00 to pay a bill of a prior fiscal year to City Hall Systems for the processing of beach stickers.

You are hereby directed to serve this warrant by posting attested copies in three public places in said Town of Chilmark at least seven days before the time of said meeting, and to publish said warrant in one newspaper having general circulation in the Town of Chilmark during the week before said meeting.
